1. Our Services

Hometown GO is a locally owned delivery service that connects customers with restaurants, stores, and vendors. We provide a platform for ordering food and goods, and deliveries are completed by independent contractors (“Drivers”). We are not a restaurant, grocery store, or vendor.

2. Eligibility

You must be at least 18 years old, able to form a legally binding contract, and comply with applicable laws to use our Services.

3. Accounts

You may need to create an account to place orders. You agree to provide accurate information and safeguard your login credentials. We may suspend or terminate accounts for fraud, misuse, or violations of these Terms.

4. Orders & Payment

• Orders are binding once confirmed.
• Prices and availability are set by vendors and may change.
• Payment is due at checkout through accepted payment methods.
• Delivery fees, service fees, and taxes will be shown before purchase.
• We may cancel orders due to vendor issues, driver availability, or suspected fraud.

5. Deliveries

• Deliveries are completed by independent drivers. delivery times are estimates only.
• You must be available to accept your order. If unavailable, orders may be left at your
  address or canceled without refund.
• Age-restricted products require valid ID at delivery.

6. Cancellations & Refunds

• Orders cannot be canceled once confirmed.
• Refunds or credits may be granted at our discretion for missing, incorrect, or damaged
  items.
• Refund requests must be submitted within 12 hours of delivery at
  info@kyhometowngo.com.

7. Vendor Responsibility

Vendors are solely responsible for product preparation, quality, and compliance with regulations. We are not liable for vendor negligence.

8. Driver Responsibility

Drivers are independent contractors, not employees. They are responsible for safe driving, vehicle maintenance, and handling deliveries.

9. Prohibited Uses

You may not:

• Use the Services for unlawful purposes;
• Attempt to disrupt or hack the platform;
• Abuse refund or promotional policies;
• Harass vendors, drivers, or staff.

10. Disclaimer of Warranties

Our Services are provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied.

11. Limitation of Liability

We are not liable for indirect or consequential damages. Our total liability shall not exceed the amount paid for the order in question.

12. Indemnification

You agree to indemnify and hold harmless Hometown GO from claims or damages arising from your use of the Services.

13. Modifications

We may update these Terms at any time. Updates are effective upon posting. Continued use
means acceptance.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky.
